Selling A Home


​The purchase of your home may be the largest financial transaction you undertake during your lifetime.  This investment should be a stress-free and enjoyable experience, however, it is essential to know that your interests are being protected.  As a qualified and experienced real estate attorney, I strive to accommodate your needs while protecting your interests.

Upon making your offer on the home you wish to purchase, be sure to consider whether the offer document contains a provision for attorney modification or approval.  It is in your best interests to make sure that this provision exists, as this allows your attorney to review the offer and note any problems, issues or concerns that need to be addressed before the contract becomes effective.  If you should sign a contract that does not contain an attorney modification provision, you may be required to complete the purchase of the home despite flaws in the contract, damage to the property or your inability to obtain financing.  Generally, real estate contracts contain such a provision, but as a precaution, you should be aware of the ramifications if one does not exist.  

During the attorney review period, the role of your real estate attorney begins.  The attorney will review the contract, address issues in the contract, negotiate critical issues that are presented after the home inspection, explain contract contingencies and negotiate other matters on your behalf.  After the contract issues have been addressed and resolved, your attorney will coordinate the transaction with your lender and assist with any paperwork that needs to be completed prior to closing.  Your attorney will then attend the closing with you to review loan documents, ensure contract compliance and assist with general closing matters.

2. Resolving issues between you and the buyer regarding the home inspection;
3. Ordering and reviewing the title commitment;
4. Ordering and reviewing the survey of property should one be required;
5. Ordering your mortgage payoffs and clearing other title matters;
6. Preparing of the closing documents such as the deed, affidavit of title and bill of sale; and
7. Attending the real estate closing.
